1. Acceptance of Terms
By accessing or using the PowerMySchool platform (the “Service”), you agree to be bound by these Terms and Conditions (“Terms”). If you are using the Service on behalf of a school or organization, you represent that you have the authority to bind that entity to these Terms. If you do not agree to these Terms, do not use the Service.
2. Description of Service
PowerMySchool is a comprehensive school management platform that provides tools for student management, attendance tracking, fee collection and payment processing, examination management, timetable scheduling, communication, report generation, library management, and related administrative functions. The Service is delivered as a cloud-based software-as-a-service (SaaS) solution.
3. Account Registration and Responsibilities
3.1 Account Creation
To use the Service, you must create an account by providing accurate and complete information. Each school is assigned a primary administrator account, which can then create additional user accounts for teachers, staff, parents, and students.
3.2 Account Security
- You are responsible for maintaining the confidentiality of your login credentials.
- You must immediately notify us of any unauthorized use of your account.
- We are not liable for any loss or damage arising from your failure to protect your account credentials.
- You are responsible for all activities that occur under your account.
3.3 User Roles and Permissions
The Service uses role-based access controls (Admin, Secretary, Teacher, Parent, Student). School administrators are responsible for assigning appropriate roles and managing access permissions for all users within their institution. Each role provides access only to features and data relevant to that role.
4. Subscription and Payment
4.1 Subscription Plans
- The Service is offered on a subscription basis with monthly and annual billing options.
- Pricing is per school and includes unlimited users (students, teachers, staff, and parents).
- All prices are listed in Indian Rupees (INR) unless otherwise stated.
- We reserve the right to modify pricing with at least 30 days’ written notice before the change takes effect.
4.2 Free Trial
- New users receive a 14-day free trial with access to all features.
- No credit card is required to start a trial.
- At the end of the trial, you must subscribe to a paid plan to continue using the Service. Data entered during the trial will be preserved.
4.3 Payment Terms
- Payments are processed securely through Stripe and/or Razorpay.
- Monthly subscriptions are billed on the same date each month. Annual subscriptions are billed on the anniversary of your start date.
- All fees are non-refundable except as specified in our Refund Policy.
- If payment fails, we will notify you and provide a 7-day grace period. If payment is not received within the grace period, your account may be suspended.
4.4 Taxes
All prices are exclusive of applicable taxes (including GST). You are responsible for paying any taxes associated with your use of the Service, unless we explicitly state that a price includes tax.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
- Upload or transmit any malicious code, viruses, or harmful content.
- Attempt to gain unauthorized access to any part of the Service, other users’ accounts, or our systems and infrastructure.
- Use the Service to store or transmit content that infringes intellectual property rights of third parties.
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Service.
- Use automated tools (bots, scrapers) to access the Service without our prior written consent.
- Share your account credentials with unauthorized individuals.
- Use the Service to send unsolicited communications (spam) to users.
- Misrepresent your identity or affiliation with a school or organization.
6. Data Ownership and Intellectual Property
6.1 Your Data
You retain full ownership of all data you enter into the Service (“Your Data”), including student records, financial information, communications, uploaded files, and school configurations. We do not claim any ownership rights over Your Data.
6.2 License to Us
By using the Service, you grant us a limited, non-exclusive license to use, process, and store Your Data solely for the purpose of providing and improving the Service. This license terminates when your account is deleted and Your Data is removed from our systems.
6.3 Our Intellectual Property
The Service, including all software, design, logos, trademarks, documentation, and related materials, is owned by PowerMySchool and protected by intellectual property laws. Your subscription grants you a non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms. You may not copy, modify, distribute, or create derivative works based on the Service.
6.4 Data Export
You may export Your Data at any time in standard formats (CSV, Excel, PDF) through the platform’s built-in export features. Upon subscription cancellation, you will have 90 days to export Your Data before it is permanently deleted.
7. Service Availability and Support
7.1 Uptime
We strive to maintain 99.9% uptime for the Service. However, we do not guarantee uninterrupted or error-free operation. Scheduled maintenance will be communicated in advance whenever possible.
7.2 Support
We provide 24/7 customer support via email, in-app chat, and phone. Response times may vary based on issue severity. Critical issues affecting service availability are given highest priority.
7.3 Updates
We continuously update the Service with new features, improvements, and security patches. Updates are applied automatically and may occasionally require brief periods of downtime.
8. Termination
8.1 By You
You may cancel your subscription at any time through your account settings or by contacting support. Cancellation takes effect at the end of the current billing period. You will retain access until that date.
8.2 By Us
We may suspend or terminate your account if:
- You violate these Terms or our Acceptable Use policy.
- Payment is not received after the grace period.
- Your use of the Service poses a security risk to other users.
- We are required to do so by law.
We will provide reasonable notice before termination except in cases of severe violations or security threats.
8.3 Effect of Termination
Upon termination, your access to the Service will cease. Your Data will be retained for 90 days, during which you may export it. After 90 days, Your Data will be permanently deleted from our active systems.
9. Limitation of Liability
To the maximum extent permitted by law:
- The Service is provided “as is” and “as available” without warranties of any kind, express or implied.
- We do not warrant that the Service will meet your specific requirements, be uninterrupted, timely, secure, or error-free.
- Our total liability for any claims related to the Service shall not exceed the amount you paid for the Service in the 12 months preceding the claim.
- We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or profits.
10. Indemnification
You agree to indemnify and hold harmless PowerMySchool, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.
11. Dispute Resolution
- Informal Resolution: Before filing a formal dispute, you agree to contact us first and attempt to resolve the issue informally within 30 days.
- Governing Law: These Terms are governed by and construed in accordance with the laws of India.
- Arbitration: Any disputes that cannot be resolved informally shall be settled by binding arbitration in accordance with the Arbitration and Conciliation Act, 1996.
- Jurisdiction: The courts of competent jurisdiction shall have exclusive jurisdiction over matters not subject to arbitration.
12. General Provisions
- Entire Agreement: These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and PowerMySchool regarding the Service.
- Severability: If any provision is found to be unenforceable, the remaining provisions will continue in full force and effect.
- Waiver: Failure to enforce any provision does not constitute a waiver of that provision.
- Assignment: You may not assign your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
- Force Majeure: We shall not be liable for delays or failures in performance due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, strikes, internet outages, or government actions.
13. Changes to These Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or prominent notice on the Service at least 30 days before taking effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
